Terms and Conditions

Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Withdrawal period: the period during which the consumer may exercise their right of withdrawal.
Consumer: the natural person not acting for purposes related to trade or profession.
Day: calendar day.
Long-term contract: a contract for recurring delivery of products or services.
Durable medium: any tool that allows information to be stored for future reference.
Right of withdrawal: the right to cancel a distance contract within the withdrawal period.
Trader: the legal entity offering products to consumers.
Distance contract: a contract concluded without physical presence of both parties.
Means of distance communication: any method used to conclude a contract remotely.
Terms and Conditions: these general terms.

Article 3 – Applicability
These Terms and Conditions apply to all offers, orders, and agreements made through Mason & Ella Toronto.
Before placing an order, the consumer has access to these Terms and Conditions. By completing a purchase, the consumer agrees to them.
If any provision is found invalid, the remaining provisions remain fully enforceable.

Article 4 – The Offer
All offers are non-binding and may be updated or withdrawn at any time.
Product descriptions are as accurate as possible. However, slight variations in color, size, or appearance may occur.
Obvious errors or mistakes in pricing or product information are not binding.
Prices listed do not include possible import duties, taxes, or customs clearance fees, which may be charged by local authorities.

Article 5 – The Agreement
The agreement is concluded once the consumer completes the order and payment is successfully processed.
A confirmation email will be sent after purchase.
We reserve the right to refuse or cancel orders if necessary.
All orders are subject to product availability.

Article 6 – Right of Withdrawal
Consumers have the right to withdraw from the purchase within 30 days of receiving the product.
To exercise this right, the consumer must notify us via email.
Returned items must be unused, in original condition, and in original packaging where reasonably possible.

Article 7 – Return Costs and Refunds
Return shipping costs are the responsibility of the consumer.
Refunds will be issued within 30 days after receiving the returned product or proof of return.
Original shipping costs are non-refundable.

Article 8 – Exclusions
The right of withdrawal does not apply to personalized products, hygiene-sensitive items once opened, products that deteriorate quickly, or sealed goods once opened.

Article 9 – Pricing
Prices may change at any time.
Import duties, VAT, or clearance fees may apply depending on the destination country and are the responsibility of the customer.
Obvious pricing errors do not obligate us to fulfill the order.

Article 10 – Product Quality and Warranty
We ensure that products meet reasonable quality standards.
If a product is defective or damaged, the customer must notify us within 30 days of delivery.
Warranty does not apply to damage caused by misuse, normal wear, or improper care.

Article 11 – Delivery
Orders are processed and delivered within an estimated timeframe of 5–14 business days, unless otherwise stated.
In case of delays, we will inform the customer accordingly.
Risk of loss transfers to the customer upon delivery.

Article 12 – Payment
Payments must be completed at the time of purchase.
If incorrect payment details are provided, the customer must notify us immediately.

Article 13 – Complaints
Complaints must be submitted via info@masonellatoronto.com
We aim to respond within 2–5 business days.

Article 14 – Applicable Law
All agreements are governed by Dutch law, regardless of the customer’s location.
